FICO focuses on five categories when calculating your score: How much debt you have, your payment history, your debt utilization ratio (how much you owe in relation to your credit limits), how far back your credit history goes and your mix of various types of credit.
Here are five sure steps to “credit score suicide”

1. Making late payments
Payment history accounts for up to 35% of your credit score and a single late payment, if you have a good credit rating, can lower your score up to 110 points immediately following the late payment.
The longer it’s been since you were late on a payment, the less of an impact it will have on your score, but “your history does follow you.
2. Carrying a big balance
Your credit utilization accounts for 30% of your credit score. Credit utilization is the percentage of credit used to available credit.
While consolidating all your credit cards into one low interest rate card makes sense from a monthly payment perspective it can have a devastating effect on your credit score.
Your magic number  here is 50% or less. If you can maintain your credit usage (across all your cards) to 50% of the available credit you won’t see your FICO score in need of life support.
3. Closing a credit line
At first that may seem counter-intuitive, but if you close a credit card it could negatively impact your credit utilization ratio AND if it is an older account, it could also affect the age of your credit history.
If the account has a zero balance and no annual fee, leave it alone until after you’ve moved into your new home.
4. Opening a credit line
In order to open a new account, a credit card company will need to check your credit, and a typical “hard” inquiry like this will lower your score by about five points, plus the cost of opening a new line of credit typically ranges from five to 15 points.
Twenty points may not seem like a lot, but in today’s first time home buyer loan market, it can make the difference between home owner and renter.
5. Defaulting
Defaulting on a credit obligation, whether it be a credit card charge off, a collection account or bankruptcy is the single worst thing for your credit score.
Declaring bankruptcy could lower a good score of 750 by up to about 250 points.
Even bankruptcy isn’t “life without parole”. If there were extenuating circumstances you may be just a couple of years from buying your first home.

ARE THERE LIMITS TO FAIR COMMENT IN A LAWYER’S SUMMATIONS TO A JURY?

In a recent case, State v. Murphy, the Appellate Division dealt with defendant’s conviction of third-degree possession of cocaine, a controlled dangerous substance.

At the trial, the police testified that they were conducting a surveillance in an area known for narcotics activity.  They observed defendant riding a bicycle.  They saw another man flag defendant down and hand defendant some money.  When defendant peddled away, the police approached the man.  At that point, the police saw defendant return, peddling toward them.  As defendant drew nearer, he dropped an item to the ground.  Police retrieved the item, and it was later identified as cocaine.

Defendant testified, too.  He denied the police account.  He testified the money was to buy beer.

In summation, defense attorney argued the police version was not believable; no person with cocaine would peddle toward the police.

The prosecutor argued that the police had no reason to lie; they had no stake in the outcome of the trial, although defendant did.  In the presence of the jury, defense counsel objected but the trial judge denied that request and held the comment to be a fair comment.

YOU BE THE JUDGE:  Should the conviction be reversed for the prosecutor’s comment?

The Appellate Division noted there is a certain latitude and even where a comment is improper, a conviction is not to be reversed automatically.  There is a three-part test: 1) whether defense counsel made a timely and proper objection to the remark; 2) whether the remarks wee withdrawn promptly; and 3) whether the court ordered the remarks stricken from the record and instructed the jury to disregard them.

The Appellate Division reversed the conviction because the remark was improper and the trial judge endorsed it by characterizing it as a fair comment.  Since credibility was a key issue in the case, the trial judge appeared to agree with the prosecutor’s argument.  Under the circumstances, the prosecutor’s remark had the clear capacity to unfairly tilt the outcome of the trial.  The Appellate Division had no confidence that the verdict was solely based on the evidence.

The Appellate Division also held that the trial judge should not have permitted the state to impeach defendant’s credibility with evidence of a prior conviction 17 years earlier.  This prior conviction had little probative value, but was unfairly prejudicial.

Big and Dangerous U.s. Gangs Making Alliances in Other States and Countries

United States gangs are expanding their sphere of influence here and around the world. Many gangs are much more sophisticated now days and are run much like military units and corporations and therefore are much more of a threat to law enforcement as well as citizens.

U.S. gangs have forged illegal business connections with other gangs in the states as well as in Mexico and Afghanistan seeking more lucrative drug markets.

 

These alliances make them much more dangerous and this organization is much more threatening. Many of the American gangs buy or are fronted drugs from the new alliances from as far away as Afghanistan where drug trades and whole selling take place. This proliferation and gangs adoption of terrorist tactic’s is worldwide and is increasingly accompanied by beheadings, shootings, kidnappings and other extreme violence and is threatening society in general.

 

 

It is estimated that there are 25,000 or more gangs currently operating in the U.S. and more than 1,000.000 active gang members. Most current gang members in the U.S. are believed to possess automatic AK 47’s, shot guns, hand guns, other weapons such as explosives and police report confiscating more and more bullet proof vests. Gangs conduct all sorts of criminal activity in all 50 states, U.S. territories, Mexico, South America, Afghanistan and else where. Although most gang activity is concentrated in major urban areas, gangs also are proliferating in rural and suburban areas of the country. 

 

Operation Community Shield that was begun in February 2005 to dismantle street gangs is hard at work but many feel it’s been a losing battle. The Department of Homeland Security said the program had led to about 7,500 arrests involving violent gangs, including Mara Salvatrucha, or MS-13, whose members are from El Salvador, Honduras and other Central American countries.

About 1,300 violent gang members who are in this country illegally were arrested in the last couple of years in U.S. Government crackdowns, federal officials announced. “We’ve arrested quite a number of very serious criminals – individuals who frankly have worn out their welcome by coming into this country illegally and committing more crimes when they got here,” said Julie L. Myers, assistant secretary of homeland security for immigration and customs enforcement.


Large street gangs readily employ violence to control and expand drug, gun, prostitution and other illegal activities, targeting rival gangs and dealers who neglect or refuse to pay extortion fees. Members also use violence to ensure that members adhere to the gang’s code of conduct or to prevent a member from leaving. Authorities throughout the country report that gangs are responsible for most of the serious violent crime in the major cities of the U.S. Gangs engage in an array of criminal activities including torturing, assault, burglary, drive-by shooting, extortion, homicide, identification fraud, money laundering, prostitution operations, robbery, sale of stolen property, and weapons trafficking.

 

Street gangs, outlaw motorcycle gangs (OMGs), and prison gangs are the primary distributors of illegal drugs on the streets of the United States. Gangs also smuggle drugs into the United States and produce and transport drugs within the country.

 

U.S. gangs are now working hand in hand with Mexican cartel gangs, according to a DEA official who wants to remain anonymous. 

Street gang members convert powdered cocaine into crack cocaine and produce most of the PCP available in the United States. Gangs, primarily produce marijuana and methamphetamine. In addition, gangs increasingly are involved in smuggling large quantities of cocaine, marijuana, heroin, methamphetamine, and MDMA (also known as ecstasy a sex drug) into the United States from foreign sources of supply.

 

Gangs primarily transport and distribute powdered cocaine, crack cocaine, heroin, marijuana, methamphetamine, MDMA, and PCP in the United States. And that illegal activity generates millions of dollars for the gangs and their members.

Gangs collect millions of dollars per month selling illegal drugs, trafficking weapons, operating prostitution rings, producing porno films and selling stolen property. Gangs launder proceeds by investing in real estate, recording studios, motorcycle shops, car washes and construction companies. They also operate various cash-based businesses, such as porno shops, porno movie houses, barbershops, music stores, restaurants, catering services, tattoo parlors, launder mats, donut shops, and strip clubs, in order to commingle drug proceeds with funds generated through legitimate commerce.

A motorcycle gang with the name of Set Free Soldiers who claim to be Christian bikers  have describe themselves as “a group of men who love Jesus and love to ride hard. “We don’t argue that,” the statement says. “All we Soldiers know is that we take care of our own and help plenty of others along the way. We try to live right in this wrong world and let our light shine wherever we may go.”

This violent gang sells videos of the group in action, including some showing members in fistfights with other people, their web site offers apparel for sale. An onesie for babies with the words “Soldier Made” written on the front in faux alphabet blocks.

Recently several members of the Set Free Soldiers where arrested for attempted murder after they allegedly got into a bar fight with the Hells Angels. Seven members of the biker gang remained in custody on million bail after their arrest for allegedly stabbing two Hells angels. In what is mostly thought of as an upper middle class naborhood in Newport Beach California late last month. Three members of the Hells Angels were also arrested.

 

According to the L A Times, more than 150 officers descended on affluent neighborhoods across Orange County California, serving search and arrest warrants on members of the Christian gang and the Hells Angels Motorcycle Club, police said. Four search warrants were served at four homes in the 300 block of South Archer Street, near Brookhurst Street and Broadway, belonging to members of the Set Free Soldiers – a biker gang allegedly masquerading as a church, said Anaheim police Sgt. Tim Schmidt.
Authorities obtained search warrants for residences of members of both motorcycle gangs, including two residences in Costa Mesa, one in Rancho Santa Margarita and four in Anaheim, said Newport Beach police Sgt. Evan Sailor. A large number of weapons and ammunition were seized in Anaheim and Costa Mesa, he said.
Overall in the case, 10 have been arrested, with police hunting for an 11th suspect, authorities said. Of these 10, seven are Set Free Soldiers arrested for alleged conspiracy to commit murder; one of them is Pastor Phil Aguilar, 60, of Anaheim, police said. He is described as the founder and director of Set Free Churches Worldwide, according to the group’s Web site.

 

The stabbings, which officials believe involved members of the two motorcycle gangs, occurred the afternoon of Sunday, July 27, at Blackie’s By the Sea, near the Newport Beach pier, Newport Beach police Sgt. Evan Sailor said.
Newport Beach officers responded to the large fight, but everyone had fled the scene, Sailor said.
Police said they determined that those in the fight were members of the Hells Angels and Set Free Soldiers. Sailor said it appears that the two stabbing victims were Hells Angels and a man hit by a pool ball was a Set Free Soldier.
 

A neighbor to one of the Archer houses with Set Free Soldiers said that the group has been a nuisance. Having young girls there all hours of the day and night.”
The neighborhood has been trying to get them out of here for years,” said Sharon Murphy, 50. “It’s supposed to be a sober-living place, but they’re always at the liquor store buying beer. They’re running their motorcycles all night long. They own three or four houses up and down the street.”

Officers arrived at 4:30 a.m. Patrol officers blocked off streets, and SWAT team members were fully outfitted – some police in camouflage and helmets rode hanging off of the sides of Anaheim police tactical vehicles and Jeeps.
By 8:30 a.m., patrol officers started letting residents of the block back in, and tow trucks arrived at around 9 a.m. to start seizing property.

 

Officers from Anaheim, Newport Beach, Costa Mesa and the Orange County Sheriff’s Department assisted in the operation.

How I Became a Better Forex Trader?

I considered myself to be an expert on equity markets when I started trading forex in 1997. I made money in stocks since early 1990’s. Yet I lost my entire first investment on forex. I traded longer term. I was hitting it big from the start. All the available leverage put me ahead 70% in just a few months. Without any info out, the market one day started to go against my bets. I added to a position, to lower entry point in an anticipation of market turn. Yeah right, market turned my way, as soon as a margin call wiped-out my entire balance.

I was stunned. My trading pride was badly hurt. I could afford to lose that money it just wasn’t good for my self-consciousness. So I stopped trading for a while and started reading. This way I actually analysed what went wrong. Basically I implemented Murphy’s Law (When all else fails read the Users Manual.).

I found an article describing the need of protecting your gains in leveraged investments. There was an anecdotal description there. You can gain 500% or even 1,000% trading in forex. You can lose no more than 100%. So gaining 500% on .000 investment makes it .000. Losing 100% on .000 brings account to zero. The moral of the story was to protect your gains and never risk too much. I made a rule to risk no more than 2% of my portfolio in one trade.

I am an economist by education and I know a lot about John Maynard Keynes. But it was years after my forex wipe-out when I found his famous saying: “Markets can behave irrational far longer than you can stay solvent.” That was a trigger to my next rule – don’t try to outsmart the market. Trade with the trend, not against it. If I think that market exaggerates I stay on the sidelines. I actually use this rule ever since in all markets. Even in Real Estate. I pay more in rising market. I sell in falling markets. Wherever I can use stop-loss, I use stop-loss (or some other strategy or combination of instruments to the same effect). Even my Home Insurance is a kind of stop-loss.

I tried that strategy and it works. I switched many trading strategies and styles of trading before I devised cross-majors strategies I use now with a success.

Also, when I first started trading forex I entered with an intention to make big profits. I tried to catch every upswing and every downswing. I overtraded, even if it paid-off at first. Than I picked a story telling that good swing traders catch 1 swing in 10. No one can catch every move. You have a choice to enter a trade or not. When you enter the trade you lose control. After you are in, the market will dictate moves and you can exit only as circumstances allow. My next rule is connected to the mind set. First I need to protect my portfolio; second goal is to make profit.

That is completely different mindset. I do not rush into every opportunity to make money with all the risks of loss associated with every open position. I wait until an opportunity that satisfies preset criteria arises. I limit my loss. I know what I will do whichever way the market turns.

There are more rules I try not to break in my trading, but these three are fundamental: Limit your risk, follow the trend and wait for the right opportunities. If used in every situation they will save you a lot of headaches.

Using stop-loss to limit my potential loss to 2% of my portfolio I can be wrong 5 times in a row and still not lose more than 10% of my portfolio. If I didn’t have stop-loss one big move against me could wipe-out my entire portfolio.

I am rarely wrong five times in a row but I have never been 100% right for more than a week.
